Aug 26th 2012 11:51AM PS: Besides the lease and addenda (I always add one of my own regarding such things as security deposits, pets, roommates, etc.), try to have all communication in writing, especially at the first hint of trouble. Emails can be invaluable in court, as well as photos of what the property looked like before and after. Tenants who were perfectly happy before you evicted them will go to court with a pack of lies about what a slumlord you were, but judges have heard it all and in my experience, the court will see through their lies; after all, if they were that unhappy, why didn't they move out without your having to evict them??

Aug 26th 2012 11:42AM To MiMi: Yes, there are a lot of bad people out there and they seem to know the law better than the good ones. That's why it is so important to take legal action against bad tenants rather than just letting it go after they are gone, leaving their messes behind. You don't need an attorney for evictions or Small Claims court. All the information, forms and assistance are online and many courts provide free legal advisors.

Aug 26th 2012 11:31AM Having been a landlord for more than half my life, I can attest to the fact that there are no guarantees when it comes to tenants. References are next to useless as people have their friends and families pose as former landlords and employers. Pay slips will at least confirm the fact that people are working and it is possible to call employers in that case, but in this economy there's no guarantee that a tenant will not be laid off, even though they may have been at that job for several years. Credit reports tell a lot and should be current up to the minute. As well, it is possible to go into the court system in your area and see what Civil or Criminal cases the applicant has been involved in. There are websites such as www.iScreenTenants.com where a landlord can check out or report tenants. The problem is that far too many landlords, when they evict tenants, do not report them or sue them. it is easy and inexpensive to take a tenant to Small Claims Court and the judgment will stay on both their court records and their credit reports for up to 7 years, as will an Unlawful Detainer (eviction); evictions are more complicated and expensive, however in my state, they usually take only 2 months from start to finish, much better than the months and months it used to take. I urge landlords not to give false references for bad tenants and to always take legal action; this way we can help each other weed them out. Check out the laws in your own state as they vary but everything is online now. Good luck to all of us!

Jul 15th 2012 6:50PM Come on now, you don't really think they believed they got a house for $5000, do you? They knew something was fishy, but being dishonorable people, they just decided to stay until they were absolutely forced to get out. And lets not forget, they got more than 8 months' rent for their $5000, which is about $625/month. What happened to them after that? They probably went looking for another crooked "realtor" so they could do it all over again.
